 Do I have to obtain the potential employee’s permission to order a background check?
Solution

As mandated by the Fair Credit Reporting Act (FCRA), employers must obtain written authorization from the applicant before ordering a pre employment background check.  The authorization document for conducting a background check must also be on a document that is separate from all other documents (i.e., employment applications or other application documents).
